Terms and conditions
Executive education booking terms and conditions
This page (together with any documents referred to on it) sets out the terms and conditions under which we provide the courses (“courses”) listed on our website https://business-school.exeter.ac.uk/for-business/executive-education/ (“site”). Certain courses, such as Help to Grow, may require additional terms due to the additional funding requirements.
Please read these terms and conditions carefully before booking any courses from the site. You should understand that by booking any of our courses, you agree to be bound by these terms and conditions.
By booking a place(s) on any of these courses, you are deemed to have accepted and agree to be bound by these terms and conditions. Once you have completed your booking and received your emailed confirmation of enrolment or a dated payment receipt, you are deemed to have a contract with the University. We will contact you if we cannot accept your booking (e.g. if you do not meet the age requirement or there was an obvious error on our website) and refund any sums paid. Please note there is a non-refundable deposit once your booking has been confirmed of £50 for all programmes except the Circular Economy Masterclass which requires a non-refundable deposit of £100.
You should print a copy of these terms and conditions and the course information page for future reference.

If you have entered into this contract for the purposes of your business, trade or profession, you are acting as a business customer. If not, you are acting as a consumer. Business customers and consumers may have different rights and we have highlighted below where this is the case.
By placing an order through our site you promise that:
- You are legally capable of entering into binding contracts (on behalf of yourself as a consumer or on behalf of your business); and
- You / course participants are at least 18 years old; and
- You do not have an outstanding bad debt with the University; and
- You / course participant have not previously been asked to leave a course of the University; and
- You / course participant are not subject to any UK or US financial sanctions or asset freezes (or are ‘Specially Designated Nationals’ – “SDNs” for the purposes of the US financial sanctions regime) or have any other sanctions that would restrict the University from providing the course to you.
You promise that all information provided to us by you for the purposes of the contract is complete and accurate, and you will provide the University with all information reasonably requested by the University in connection with the course(s) for which you have enrolled.
If you are booking the course for yourself, you are responsible for ensuring that the course selected is suitable for your level of experience and desired outcomes. The University will not assume responsibility for your choice. Nor does it make any commitment to you that any particular outcome will be obtained from completion of the course and/or use of the study materials.
If a course registration/booking form is completed by an individual other than the named participant, it is the responsibility of the person authorising the booking to ensure the course is suitable for the participant.
The University will send all correspondence primarily via email to the email address provided on the booking form. If alternative details are received after the booking form has been submitted, they will supersede the original details and all future correspondence will be sent to the new address.
These courses may have elements that are online only, and some may have face-to-face elements. These courses do not have any academic credit or formal University of Exeter award attached to them or any accredited CPD (Continuing Professional Development), however you may be able to request a certificate of completion.
You will not be a registered student of the University of Exeter, however you may be provided with access to an online learning portal (the University currently uses its own platform called Learn.Exeter or an external platform called 'NovoEd'). You will not have access to any other student support service offered to registered students at the University of Exeter or a student card.
Course participants must comply with any end user terms contained within the online learning portal, and the Code of Conduct set out in section 15 below. The University may remove a participant from a course if the behaviour or demeanour of the participant is considered unacceptable. Under these circumstances the participant should not expect any reimbursement for the course fees or any other losses they may have incurred.
The University prohibits the use of AI bots or other artificial intelligence / computer programmes to join or record live webinars (unless they have been pre-approved in writing).
It is your responsibility to ensure you have received joining instructions prior to the date of the course and to contact the University to arrange for them to be reissued in the event of non-arrival by the start date of the course.
Online learning resources and course materials will be available (if applicable to your course) on your account for a limited period only (usually only 2 weeks after the end of the course).
It is your responsibility to check that the computer you plan to use to access an online course is compatible with the minimum specification requirement for accessing the course materials and websites. This information for NovoEd can be found at https://help.novoed.com/hc/en-us/articles/213146806-NovoEd-Technical-Requirements-and-Browser-Compatibility. Learn.Exeter uses Moodle 4.1 which is compatible with any standards-compliant web browser. Moodle is regularly tested with the following browsers:
- Desktop: Chrome / Firefox / Safari / Edge (NOT Internet Explorer)
- Mobile: MobileSafari / Google Chrome
For the best experience and optimum security on Learn.Exeter, we recommend that you keep your browser up to date and have access to an authenticator app to set up your account.
You confirm that the University will not be held responsible for any technical problems encountered following the purchase of a course granting you access to such course materials and/or websites. If you do encounter problems using the online learning portal, you can contact us: executive-eduction@exeter.ac.uk.
The University cannot guarantee uninterrupted availability of online learning resources. In particular, the University may suspend access to the website or online resources for the purpose of scheduled or emergency maintenance, repairs and upgrades, to improve performance and functionality or to reflect changes in relevant laws and regulatory requirements. The University will however, endeavour to inform you of such suspension, keep such interruption of online services to a minimum and out of normal business hours where possible.
The course fees include the services set out in the course advertisement as amended by the University from time to time, and usually include registration, access to all parts of the course, course materials except where materials cannot be provided online, and a certificate of completion. Fees do not include any materials or expenses incurred by you for your private study. Fees do not include any travel or accommodation costs that you may require for attending face-to-face elements of a course.
Any additional mandatory course materials that cannot be provided online will be listed on the course advertisement. We advise against purchasing these in advance of the course being confirmed as running, as any associated costs are not the responsibility of the University and are purchased at your own risk should the course be cancelled.
All our courses are delivered in English, except where otherwise clearly stated, and all administrative support is only provided in English. Participants whose first language is not English should feel competent and comfortable using written English. If a course has any mandatory entry requirements or suggested prior knowledge, we will set this out on the course site.
Visa and immigration status: When you register, you must provide your home country. If you are not resident in the UK, certain courses may not be available to you. It is your responsibility to check you have the correct immigration permission and visa status if you plan to attend a face-to-face element of the course. The University does not provide visa sponsorship for these courses.
Any information or content provided on the course is given on an “as is” basis, and no warranty (i.e. promise) is given as to quality, accuracy, completeness or fitness for a particular purpose. Case studies and examples may be limited to the UK. The University is providing educational training, and not professional advice which can be relied upon.
You may request a pdf certificate of completion after successful completion of the course (by email). The name of the student given on the booking form will be the one that appears on the certificate.
Some courses will have assessment criteria meaning you may either pass or fail the course. We will tell you what the assessment criteria is (if any) at the beginning of the course. The certificate of completion is NOT a qualification.
No results or certificate(s) will be issued whilst there is an overdue balance of fees due to the University.
Minor changes: We may change the course:
(a) to reflect changes in relevant laws and regulatory requirements (for example, a minor change to the content of the course);
(b) to reflect best practice and up-to-date real world examples; or
(c) to implement minor technical adjustments and improvements, for example to address a security threat to the online delivery of the course.
These changes should not affect your participation on the course.
Major changes: We do not anticipate having to make any major changes to these terms or the course, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any courses paid for but not received.
For current course fees and dates, please refer to our site (https://business-school.exeter.ac.uk/for-business/executive-education/). The course fee will be as quoted on our site at the time of order, except in cases of obvious error.
Unless otherwise agreed in writing by the University (or there is an applicable concession), the fee/price for the course will be the fee/price displayed on the website and displayed on the online booking form. Should value added tax (VAT) be payable, the fee/price will clearly state that VAT is included in the fee/price or shown as an addition. That fee/price is subject to the addition of all costs or charges in relation to postage, carriage and insurance where applicable and where we have made this clear to you.
Full payment of fees must be received prior to your commencement of the course unless you cancel your course booking within the period of eligibility for a refund as per our ‘Refund Policy’ set out below. Your place on the course cannot be guaranteed until full payment is received. If payment is not received prior to the commencement of the course, the University may withdraw your place on the course; and/or we may charge interest on the overdue amount at the rate of 4% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You pay us the interest together with any overdue amount.
Fees are payable in GBP and in the event of a refund, you will be refunded in GBP. The University will not be liable for any losses incurred as a result of currency fluctuations or exchanges.
Fees/prices are liable to change at any time without prior notice, but changes will not affect any bookings already placed.
It is always possible that, despite our best efforts, some of the courses or course options listed on our site may be incorrectly priced. If the correct price for a course or a course option is higher than the price stated on our site, the University will normally, at our discretion, either contact you or cancel your order and notify you of such cancellation. Any price paid will be refunded to you but we shall have no liability to you beyond the price paid.
The University is under no obligation to book you on a course at an incorrect lower price, even after we have sent you an order confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.
If you are a business customer, all sums due shall be paid in full and in cleared funds, without any set off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
Methods of Payment
You will either be requested to pay online (credit or debit card), or if you are a business customer we may agree to issue an invoice to you which will contain relevant payment details. Please provide a company name, address and any purchase order with your booking if you are booking as part of a company. Payment is required immediately upon receipt of the invoice. Please note that we do not accept American Express or cash payments.
Concessions
Concessions, discounts or even free spaces may be offered, from time to time, however they may only be honoured if the participant can provide any required evidence (for example, evidence of relevant employment and a relevant code).
As with all concessions, they must be claimed by the participant at the point of booking and will not automatically be applied retrospectively, and will be subject to the University’s discretion.
In the event of there being insufficient numbers booked on a course or the unavailability of a tutor, the University may cancel or postpone the course and will notify you of this in advance. In the event we cancel, you will receive a full refund. In the event we postpone, you will have the option to undertake the course on the revised dates, or you may wish to transfer to an alternative course (see ‘Transfers’ section below). If you do not wish to do either of these, then you may cancel your place and receive a refund in accordance with the ‘Refund Policy’ set out below.
Publicised course tutors may be subject to change. Where there is a change in tutor, the University will endeavour to give as much notice as possible in advance of the course start date. The University cannot guarantee that teaching or supervision will be provided by any particular named individuals.
Our programme of courses is subject to continuing development and changed circumstances may necessitate cancellation or alteration to the programme of courses. The University reserves the right to make variations if such action is considered necessary and in such circumstances will take all reasonable steps to minimise any resultant disruption, but we do not accept any liability arising out of or in connection with any such changes.
The University may also end the contract with you, or suspend your access to the course, at any time by writing to you if:
(a) you do not make the correct payment to us before the commencement of the course; or
(b) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the course; or
(c) you seriously breach/break the terms set out in this contract; or
(d) you give your login details to, or share course content with, a third party without the University’s permission; or
(e) you seriously breach/break the rules and regulations of the University, the Code of Conduct set out in section 15 below, other online learning portal user terms, and/or applicable law (including using any AI bots or other artificial intelligence / computer programmes to join or record live webinars without explicit prior written consent by the University); or
(f) it would become illegal for us to continue providing the course to you; or
(g) you do not have the required mandatory linguistic or other eligibility criteria to undertake the course; or
(h) for any other reason that, in our reasonable discretion, means your continued attendance at the University is inappropriate or unsafe, either for yourself or for your fellow participants and /or University staff.
If you are a consumer (i.e. you are not acting as part of a business), you have a legal right to change your mind during a 14 day ‘cooling-off’ period (subject to some conditions below). This means that you have 14 days from the date the University confirms your enrolment, in which to cancel your booking for any reason and be entitled to a refund in accordance with our ‘Refund Policy’ below.
However, once we have completed the delivery of the course you cannot change your mind or cancel your booking.
If you change your mind after we have started to deliver the course to you, you have to pay for any part of the course you have received. If you cancel after we have started the course or after we have scheduled a place with our IT provider and incurred costs, you must pay us for the part of the course provided up until the time you tell us that you have changed your mind (see our ‘Refund Policy’ below) which may include a £50 fee to cover our set-up costs of all programmes except the Circular Economy Masterclass which has a £100 fee.
Once we have accepted your booking you will remain liable for the fee amount in full unless you cancel your place on the course in writing. Any refund will be subject to our ‘Refund Policy’ below.
All requests from participants to cancel their course booking must be received in a clear written statement by email to executive-education@exeter.ac.uk which will be acknowledged. We set out a standard form for cancellations at the end of these terms which you may want to use.
In the case of non-attendance or non-completion of the course by a participant, except in exceptional circumstances, the fee for the course will be forfeited and not be refunded. See the ‘Refund Policy’ below for more details.
If you are acting as part of a business, then this 14 day ‘cooling-off’ period does not apply to you. Subject to the ‘Transfers’ section below and our ‘Refund Policy’, we may accept transfers or cancellations from you.
If there is another reason to cancel: If you are ending a contract for a reason set out at (a) to (e) below, the contract will end immediately and we will refund you in full for any part of the course which has not been provided and you may also be entitled to compensation. The reasons are:
(a) we have told you about an upcoming major change to the course or these terms which you do not agree to (see section 5 above);
(b) we have told you about an error in the price or description of the course you have ordered and you do not wish to proceed;
(c) there is a risk that supply of the course may be significantly delayed because of events outside our control;
(d) we have suspended supply of the course for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 30 days; or
(e) you have a legal right to end the contract because of something we have done wrong.
Transfers
If you can no longer attend the course, or if you are a company and have paid for an employee to attend and they can no longer attend you may wish to consider the following options:
- a) If you have a colleague that can attend in your/their place, then this may be arranged prior to the course start date, or we may consider transfers after the start date. Any such changes to the original booking will be considered on a case by case basis, and must be notified to the administrator executive-education@exeter.ac.uk at least 14 days prior to the start of the course. A £10 administration fee may be chargeable. In addition, we may retain a £50 non-refundable deposit for all programmes except the Circular Economy Masterclass where we retain a £100 non-refundable deposit if the transfer occurs after the course has started and/or if your place has already been scheduled with our IT provider (and we cannot recover our costs).
- b) You may wish to transfer to a different course. Requests to transfer must be received by us at least 14 days prior to the start of the course originally booked, and will be subject to availability of places on the new course. If the cost of the course you transfer to is less than your original payment you will be refunded the balance. If the new course fees are greater you will be asked to arrange payment accordingly prior to the start of the new course. A £10 administration fee may be chargeable.
All transfer requests must be given in writing. Transfers will not be considered complete until any applicable administration fee has been paid in full. The administration fee will cover re-registration, set up of access to the alternative course materials and administration of participant booking information. See our ‘Refund Policy’ below for details on the non-refundable deposit.
Administration fees for transfers will be waived if the request for transfer is due to medical or compassionate grounds supported by relevant written evidence.
Cancellation within your 14 day ‘cooling off’ period as a consumer
If you are a consumer (i.e. you are not acting as part of a business), and if you cancel your place on the course within your 14 day ‘cooling off’ period you are entitled to a refund, subject to the following:
- If you exercise your right to cancel before the course begins, we will reimburse you all payments received from you, or offer to transfer you to another course (subject to the ‘Transfers’ section above) where appropriate.
- If you want to begin the course during the 14 day cooling off period, we will reimburse you all payments received minus an amount which is in proportion to the fee for the number of days/weeks’ course material access you have had prior to you communicating to us your cancellation of this contract, which will include a non-refundable deposit of £50 for all programmes except the Circular Economy Masterclass where we retain a non-refundable deposit of £100to reflect the booking of your place with our IT provider and/or our internal set-up costs. If you have not yet paid for the course, we will revise your invoice and you shall pay as set out above.
Cancellation as a consumer (in addition to the 14 day ‘cooling off’ period) or as a business
If you are a consumer or a business, and would like to cancel your place on the course at any time, any refund will be subject to the following (and does not affect a consumer’s 14 day ‘cooling off’ period above):
- If you wish to cancel before we incur any costs (e.g. before the course begins or before we have scheduled your place with our IT provider), we will reimburse you all payments received from you, or offer to transfer you to another course (subject to the ‘Transfers’ section above) where appropriate.
- If we have confirmed your booking and scheduled your place with our IT provider, or if you begin the course, we will reimburse you all payments received minus an amount which is in proportion to the fee for the number of weeks’ course material access you have had prior to you communicating to us your cancellation of this contract, which will include a non-refundable deposit of either £50 (most programmes) and £100 (Circular Economy Masterclass) to reflect the booking of your place with our IT provider or internal set-up costs. If you have not yet paid for the course, we will revise your invoice and you shall pay as set out above.
- No refunds made if the course has completed.
When and how we refund you
Refunds made by the University will be paid to the original payer in the same method that the original payment was made. In the event that this is not possible, you will be contacted by a member of University staff to discuss and arrange an alternative payment method. If we need to reimburse by international bank transfer we will deduct bank charges.
We will make the reimbursement without undue delay, and not later than 14 days if you are a consumer or 30 days if you are a business after the day on which we are informed about your decision to cancel the contract.
Non-attendance on courses due to illness or for personal or professional reasons does not automatically give rise to the right for refunds or a transfer. However, in such an event we will consider all the circumstances on a case by case basis and take such action that we consider to be fair and reasonable.
The copyright and other intellectual property rights in relation to course materials remain the exclusive property of the University or our licensors.
In attending the course, you agree that only you will use the course materials for the purpose of undertaking the course. . You will not copy or permit to be copied any of the course materials for any other purpose or person, nor disclose or permit the disclosure, sell or otherwise pass on those materials to others, unless agreed otherwise in writing with the University. Certain materials (including all recordings) will not be available for download or printing, instead you may be given view only access for a limited period of time. You may take your own notes, but you must not record any of the webinars / teaching sessions or introduce any AI bots or other artificial intelligence / computer programmes to join or record live webinars.
As a participant on the course you are granted a non-transferrable, non-exclusive licence (i.e. right) to use the course materials solely for the purpose of receiving and using the course in your personal capacity and/or your employer’s business including putting into practice the knowledge passed to you by the University. You and your employer may not trade in any such knowledge nor redeliver such training internally or externally whether for commercial reward or otherwise, and shall have no rights to commercially exploit any course materials. You may not use the University’s name or logo unless authorised by the University in writing.
The University may suspend your access to materials at any time if it suspects or is aware that you have broken the terms set out in this contract.
The University gives no promises nor makes any representations in relation to any IP provided or created in the course.
You confirm that you will reimburse the University in respect of any infringement of any such IP rights arising as a result of your mis-use of the University’s IP rights and requirements.
Usernames and passwords are for personal use only and should not be passed to anyone else. You are required to protect your log-in information at all times, as content stored on the University online learning portal is protected by the same IP rights as set out above.
All personal information obtained by the University both from yourself and other sources will be used to process your booking on the course(s), and to enable you to access materials and online resources for your course.
If the University reasonably believes it has reason to do so, the University may pass this information as appropriate to other outside organisations, including the police, government, and other institutions in order to prevent or detect fraud, or any other unlawful activity.
The University may ask you for feedback, to be used internally to consider changes to the course or for external testimonials.
We will only use your personal information as set out in our privacy notice here.
If you think that you are likely to require any support because of a disability and/or learning difficulty while you are on the course, you are advised to contact executive-education@exeter.ac.uk for further advice or guidance.
All requests for support will be considered in line with the criteria for “reasonable adjustments” as outlined in the Equality Act 2010. The University encourages you to contact it as soon as possible in order to make appropriate arrangements for you.
The University makes every effort to ensure you enjoy your course of study. In the unlikely event that you have a complaint about any aspect of the University or your course, this should be made in the first instance to the department via email executive-education@exeter.ac.uk.
While the University aims to ensure that the information on the University website and online portal is correct, we do not promise the accuracy and completeness of the course material on the site or in any published brochures or prospectuses relating to the course(s). We may make changes to the material on the site or to the prices described in it at any time without notice.
The University is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment or software, failure of any email or online application to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any combination of these, including any injury or damage to a participant’s or other customer’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials.
The University accepts no liability for:
(a) any payment not reaching the University due to provision of incorrect account numbers or personal details;
(b) any payment which is refused or declined by your credit or debit card supplier for any reason; and
(c) bringing to your attention the fact that your card supplier has declined payment. It is your responsibility to check that payment has been deducted from your account.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and if you are a consumer (i.e. you are not acting as part of a business), for breach of/breaking your legal rights in relation to the course including the right to receive services supplied with reasonable skill and care.
Where you are acting as a consumer: We are responsible to you for loss and damage you suffer caused by us breaking this contract unless the loss is:
(a) unforeseeable or unexpected (i.e. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it); or
(b) something you could have avoided by taking reasonable action; or
(c) caused by an event outside our control (see ‘We are not responsible for delays outside our control’ below).
Where you are acting as a business: Subject to those liabilities we cannot limit by law, our liability for losses you suffer as a result of us breaking this contract is strictly limited to the fees of the course you purchased. We are not liable for loss of profits, loss of sales or business, loss of agreements or contracts, loss of anticipated savings, loss of use or corruption of software, data or information, loss of or damage to goodwill and any indirect or consequential loss.
Changes to these terms:
We have the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions in force at the time that you booked your course with us, unless any change to these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).
If you are a business customer, this is the entire agreement:
If you are a business customer, these terms and conditions and any documents expressly referred to in them represent the entire agreement between the University and you in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
The University and you, each acknowledge that, in entering into this contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these terms and conditions.
Neither the University nor you shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.
Any unlawful terms:
If any of these terms and conditions or any provisions of the contract are determined by a court or any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
No transfer:
This contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of this contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of this contract, or any of our rights or obligations arising under it, at any time during the term of the contract and will notify you if this happens.
Nobody else has any rights under this contract:
This contract is between you and us. No other person shall have any rights to enforce any of its terms.
Even if we delay in enforcing this contract, we can still enforce it later:
No failure to exercise, nor any delay in exercising, on the part of a party, any right or remedy under these terms and conditions shall operate as a waiver, nor shall any single or partial exercise of any right or remedy prevent any further or other exercise or the exercise of any other right or remedy. The rights and remedies provided in these terms and conditions are cumulative and not exclusive of any rights or remedies provided by law.
We are not responsible for delays outside our control:
We are not responsible for delays outside our control. If our supply of the course is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any course or part of a course you have paid for but not received.
Communication:
When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This term does not affect your legal rights.
Which laws apply to this contract and where you may bring legal proceedings:
These terms are governed by English law and you can bring legal proceedings in respect of the services in the English courts. If you are a consumer and are a resident of Northern Ireland, Wales or Scotland you may also bring proceedings in that country as applicable.
